I had previously sent payment via online payment provider to an individual (not in NY state) selling car parts via another forum/website.  The seller has not sent the parts that were paid for in full, and has not refunded me payment.  What are my options, before this drags out any longer?

I know there's a few of you with some legal background, so if there's any good suggestions, please let me know or PM me.

I can't say for the legal routes, but depending on how you sent the money you may be able to get it back through them.

did you pay with paypal? i only have dealt with them in the past with a non shipping seller. the gave the seller a time period to resolve the matter. In my case the seller never responded so they(paypal) issued a refund

I did pay with paypal, but it's outside of the dispute timeframe.  Also, my bank that I have the mastercard through also said it's outside of their timeframe for filing a dispute/compaint.

Well, in 'attempting' to work out something multiple times with the seller, I've let it drag out for about 6 months now.

Yeah, bad idea, eh?

LOL  yeah, very bad....but I understand why.  I've let things drag out for the same exact reasons, and gotten screwed as well  :|

Does anyone know of a good lawyer that might be able to point me in the right direction?  I really am not sure where to start with this.

Ohio- I believe Franklin County.

It was less than 3K, so I can file small claims.

Thanks sir- yeah, the guy seemed to be pretty good about working stuff out, but it just kept going, and I really can't afford to let it drag out any longer.

No. Not possible, unless you mean "small claims court in Ohio". The defendant is out of state.

Call paypal directly if you haven't already. I am presently dealing with someone who scammed me out of $200. I went the online route then called them. They said I should have my money within 10 days. This was last week, I have been dealing with this for almost 2 months now. Just my 2 cts good luck

Yeah I agree. Even though it has been 6 months I would still contact Paypal. They'll help. Especially since its more than $1k. At least I would hope they would.

And I'm hoping you have records of all communication with the seller.

Ugh, I was being hopeful- so yes, I tried working with paypal already and no luck.  I tried working with my bank as the credit card backing the transaction is provided by them, no luck there either - outside of 'dispute' timeframe.  But yes, I do have all records of correspondence with the seller... I'm currently waiting on hearing back from the county prosecutor's office in Ohio on what they might be able to do or what is suggested.

Basically, almost everything I've heard/found so far points to getting a lawyer and having them deal with this; I doubt this will be remotely quick/easy.

Yeah looks like that will have to be the way to deal with it. Keep us updated. I hope it works out.
