Here is an e-mail that I sent them today.

"I am leaving this message to let you all know I am going to do everything within my reach to let everyone know what you all have done to me. I bought a 2002 WRX last year in september and have been unable to pass inspection. After a few different re-inspections and diagnostic leak tests, no one has been able to determine what is causing the evap leak CEL to come on. Upon further inspection, the subaru dealership I have brought the car to in desparation has told me the cost to get the car to pass will most likely eclipse it's value.

There are no catalytic converters on the car and the ECU most likely has been re-programmed. Basically everything has been thrown together on the car in a haphazard fashion. Nothing was done in a legitimate professional manner. Basically there is a nightmare of issues affecting this car.

I traded in a new car and made the mistake of trusting your business. I know you may not get in contact with me. I also know you probably will do nothing to defend your businesses reputation by rectifying the situation.

You sold me a car that was not only illegal, and broken, you have caused us a great deal of financial ruin. I am going to look into legal avenues as well.

So if this is what you want, so be it. There is nothing that you can say to defend the fact you sold me a car that was trash for a premium price, that I will never be able to legally drive.

Thank you for making our life a living hell since I became your customer."


I was stupid for buying the car for $15000 :uglystupid2:. It will cost me thousands to pass NYS inspection. I am also upside-down on the loan. Do not go to this dealership ever, no matter what!

sorry about your car man, that sucks. Im pretty sure there are legal actions that you can take.

you might be able to turn off those evap codes like my O2 sensor codes are turned off....

that's exactly what I was thinking.

Did you get the issues solved with the dash lights shutting off and the car shutting off?  It's an '02 so you can pass NYS inspection if your evap system is "not ready" as long as you don't have any other cel's.  Is the car driveable besides the no inspection?  I'm up in the Glens Falls/Saratoga area and I've got a tatrix cable.  So I could shut off the evap code and see if you have any other ones.

And honestly, good sir, thank you for your review.  I can only imagine how frustrating this is for you.  Where is this dealership located(state)?

Yes, you have at least one statutory and probably other common law avenues of legal recourse.  How much recourse will probably come down to documentation and time-line.  In your favor, the problem (at least right now) is not solely mechanical (like the engine blew up) but rather related to hardware and mechanical problems related to hardware.  These things are not necessarily mileage or time dependent which is important for statutory remedies.  Please tell me this email is not the first time you brought this to their attention? I know you had problems a while ago.

Quote me now while I'm feeling good about it.  I've decided a WRX will be the vehicle that replaces the Jeep.  I can't see paying Evo prices or justifying purchasing a halfassed/beat to death example for the same asinine amount of money.  For an affordable, point to point, all-weather capable performance car, a wagon fits the bill.  A swapped wagon, even better.

This wasn't the first time I have contacted them. I have spoken to them and dealt with them since september.

It is at Capital land subaru right now. They think the ECU might be tampered with. They did the smoke test and nothing is leaking.

Is this car even worth keeping even if I do get it fixed?

  sorry to hear it man.  as for it being worth it if you fix it....yes  i just hope its not that big of a fix and you get some kind of settlement in your favor.

I don't really want to get into strategy on an open forum but you should have Capitaland go though and list everything that is wrong with the car that could be related to electrical/emissions/etc, basically anything and everything that is related to what you have already put them on notice about.  This would also include all of the exhaust modifications, especially since it sounds like they sold you a car that is in direct violation of federal emissions statutes.  This list should also include dollar values for fixing all the problems.  I am sure Fred would be able to point all possible problems and places to look for different problems (such as hacked harnesses etc...).

I hate to ask but how old are you?  How involved have you parents been in getting these problems resolved?  Just trying to gauge the overall nature of the situation.

The car isn't a loss, you just need to receive the benefit of the bargain that you thought you made when you purchased the car.  This will simply require things to be fixed, correctly.

I am 24 years old and my parents have no part in this. I have excellent credit, and traded a car I bought new for this one. Unfortunately I made the mistake in trusting the dealership I bought this car from. I am currently trying to make up a letter to the attorney General in Connecticut to help resolve the situation.

Is there anything else that I should do in addition?

Go ahead with the letter to the Atty Gen, make sure it is very detailed and lays out your claim with respect to the statutory warranty I posted above.  If you would like you can email me a draft for review.  Keep in mind that this may not be the answer to your problems because the Atty Gen may not move very fast on this, if at all.  That being said, it is definitely a nice card to play when negotiating with the dealer.

Let me do some digging on this and I will see what else I can come up with today or tonight.  Was the car sold to you w/o catalytic converters or with some of them removed?

With Romraider you can "force obd2 readiness" and also disable the evap cel.  If you're near Albany I can do it.

The dealership offered to pay for all repairs. I have the inspection out of the way though.  :wink:

I don't have the time of the money to deal with a whole legal ordeal. The only thing I want them to do is end me the factory boost control unit or something. I will post pictures in the forum somewhere else soon, but I have some wierd stuff going on in that part of the engine bay.

That is sort of like what I ended up with. It looks like someone had modded it and parted it out before selling it.
